Under Ministry of Transportation (MTO) regulations, commercial motor vehicle operators caught driving under an HTA-related suspension, including default of family support, will not be subject to a seven-day impoundment if the driver's licence has been suspended for less than 100 days.
Carriers who check the status of their drivers' licences (every three months) should be able to catch any suspended drivers in time to ensure that they do not run the risk of having their equipment impounded.
The seven-day vehicle impoundment will apply to drivers whose licences are suspended for:
- Driving while under certain Highway Traffic Act licence suspensions including non-payment of family support
- Driving with a blood alcohol concentration over .08 (beyond the legal limit) or for failing/refusing to provide a breath sample
- Driving without an ignition interlock device when one is required.
