The FINE may be a hundred dollars, but what’s the real cost of losing? If your insurance increases from perhaps $1000 per year to $1600 per year, for FIVE YEARS, that’s thirty times the cost of the fine! And just two convictions in three years can qualify you as a High Risk candidate, where the rates START at $5000 per year!

If you fight this ticket successfully, then your next ticket becomes your first. (And you didn’t intend to get this one, right?) And, as common sense will tell you, your insurance company will take a much sterner view on a conviction for Reckless Driving, than for a dirty license plate, even as a first offence. Bottom line? Fight EACH ticket like it’s the one to cost you your license.

But I’m guilty! How can I plead “Not Guilty”?
Do you know what Prosecutor has to prove in the charge you’re facing? If so, is that evidence available? You quite likely have no idea if you’re guilty. Are you “ethically” bound to plead guilty? On the contrary! Technically, you can’t plead guilty unless it’s an informed plea, which means you understand those facts that make up the charge, and concede their accuracy. In effect you are simply waiving the necessity of the Prosecutor to prove your guilt, which you should never do unless you have a bad driving record, and the Prosecutor is prepared to negotiate on penalty, or you’re facing multiple charges and the Prosecutor is offering to withdraw some in exchange for pleas to others. Also, consider these two points: 1) only in traffic court does there exist the seductive “Guilty with an explanation” plea. This does not mean “Kinda Guilty”. Guilty is guilty. It is an opportunity for you to plead guilty to the offence and make application for a lesser fine. THAT’S IT. The conviction is entered, and the demerit

If the policeman doesn’t show me the radar, can I get off?
If you do, that’s not why. The policeman never has any obligation to prove guilt to the person charged; His duty is only to inform the accused of the nature of the charge itself, and his/ her options should they wish to dispute it. In fact, it is quite common that the charge resulted from a pace, where there IS no radar, or by aircraft, or electronic device on a toll-highway, where the officer issuing the ticket is someone other than the one with the radar!
