Driving While Under Suspension

Driving with a suspended license is one of the most serious offences under the Highway Traffic Act.
A conviction for driving while under suspension carries an automatic six-month suspension of your drivers licence and the conviction will have serious implications for insurance premiums.  If convicted of driving under suspension, you could end up paying thousands of dollars more per year for insurance….or you may not qualify for insurance at all. 

Your license could be suspended for a number of reasons, including but not limited to:

  • Unpaid fines
  • Medical reasons

If this is the first time you have been charged with Drive under Suspension, you are facing the following penalties:

  • A fine not less than $1,000 and not more than $5,000 (**Note:  If your license is suspended from certain convictions under the Criminal Code of Canada, the fine is not less than $5,000 and not more than $25,000**)
  • A mandatory 6 month suspension of your driver’s license
  • A possible term of imprisonment of not more than 6 months

For each subsequent offence:

  • A fine of not less than $2,000 and not more than $5,000 (**Subsequent offences related to the Criminal Code: fine of not less than $10,000 and not more than $50,000**)
  • Suspension of your driver’s license
  • A possible term of imprisonment

Starting December 1st, 2010, police will have more tools to get suspended and impaired drivers off the road. This change will also mean added enforcement against people who have had their driver's licences suspended for consistently not paying family support.
