New York State Driver Violation Points
Drivers convicted of certain driving-related violations can have Driver Violation Points recorded on their driving record. These points are recorded over an 18 month period and used to determine whether or not your licence will be suspended.
If your point total reaches 11 points or more within an 18 month period, the DMV notifies you and suspends your driver license.
The following are the most common violations and the points that will be assessed to your driving record.
- Speeding (1-10 MPH over posted limit): 3 points
- Speeding (11-20 MPH over posted limit): 4 points
- Speeding (21-30 MPH over posted limit): 6 points
- Speeding (31-40 MPH over posted limit): 8 points
- Speeding (more than 40 MPH over posted limit): 11 points
- Reckless driving: 5 points
- Failing to stop for a school bus: 5 points
- Following too closely (tailgating): 4 points
- Inadequate brakes: 4 points
- Inadequate brakes while driving an employer's vehicle: 2 points
- Failing to yield right-of-way: 3 points
- Violation involving a traffic signal, stop sign, or yield sign: 3 points
- Railroad-crossing violation: 3 points
- Improper passing, unsafe lane change, driving left of center, or driving in wrong direction: 3 points
- Leaving the scene of an incident involving property damage or injury to a domestic animal: 3 points
- Safety restraint violation involving a person under 16: 3 points
- Any other moving violation: 2 points
Driver Safety Assessment Fee
In 2004, New York State started the Driver Responsibility Program. The fees imposed as a result of this program are significant and should be part of your decision making process when determining whether to fight a New York traffic ticket and or hire someone to assist you.

You must pay the Driver Safety Assessment Fee if in New York State:
- You receive six or more points on your driving record during a period of 18 months
NYS Department of Motor Vehicles will impose Driver Safety Assessment Fees on any driver who accumulates more than "6 points" in any 18 month period (from date of offence). The fees begin at $100/year for 3 years (for 6 points) and increase by $25/year for 3 years for each additional point.
ALL FEES ARE IN ADDITION TO ANY FINES IMPOSED BY THE COURTS.
6 points = $300 $100/year for 3 years
11 points = $675 $225/year for 3 years
