How to Fight a
Careless Driving Ticket

Retaining qualified legal representation to fight a Careless Driving traffic ticket is crucial. The penalties for this offence are quite severe if you plead guilty.

Careless Driving is a charge that is usually given to someone who has been involved in a collision. It is a very broad charge that covers many different driving situations.

You can be charged with “careless driving” if you are found at a high risk of “driving a motor vehicle without due care and attention, or without reasonable consideration for other persons using the highway“.

The penalties for being convicted of “careless driving” are highlighted in the Highway Traffic Act as follows:

  • 6 demerit points
  • A speeding ticket for a minimum fine of $400 and no more than $2,000
  • Possible suspension of your driver’s licence for a period of no more than two years
  • Possible term of imprisonment for up to six months

Increased Vehicle Insurance Rates – The highest financial cost of a “careless driving” offence may be the significant increase in your insurance premiums due to its effect on your driving record. Your premiums will increase for at least three years from your Insurance company.
