Failing to stop at a red light is a serious offence. You can face numerous penalties depending on the severity. In order to receive a red light charge, you would have to enter an intersection after the light had turned red. You should not, under any circumstances, do so. When you are caught, you can face major fines and legal consequences.

What Is It?

As mentioned previously, if you are caught entering an intersection after the light has turned red, you could face charges of failing to stop at a red light. Even if the light is yellow when you enter the intersection, you still can be charged, however it is a different offence with similar penalties.  It is safest to slow down and stop at an intersection when the light is yellow to prevent the possibility of receiving a failing to stop charge or causing a collision.

You can also receive a red light charge for failing to stop when turning right or left at an intersection. You are required to come to a complete stop and yield for any pedestrians crossing the street if the light is red in the direction you are travelling before your intended turn.

Where Does A Driver Stop?

For all experienced or new drivers, it is important to understand where you must stop so you don’t receive a traffic ticket. The Highway Traffic Act states that:

  • A driver must stop at the stop sign or roadway marking at intersections equipped with traffic lights;
  • A driver must stop right before entering the nearest cross walk if there are no roadway markings;
  • A driver must stop immediately before entering the intersection if there are no roadway markings or crosswalks.

Penalties

Whether you are caught by an officer or by a red light camera, the penalties can be severe. The following is a list of some penalties you can incur:

  • monetary fine between $200-$1000, plus court fees;
  • Loss of 3 demerit points;
  • Driver’s license suspension (for non-payment of fines); or
  • Insurance premium increases.

Importantly, your car insurance rates may increase significantly with a conviction of failing to stop at a red light on your driving record.
